Delhi MCD Mayor Election 2023: The way has been cleared for the election of the mayor of the Municipal Corporation of Delhi. The Supreme Court on Friday (February 17) gave a big relief to the Aam Aadmi Party (AAP), saying that the nominated members in the election will not vote and within 24 hours a notice should be issued regarding the election. AAP had approached the Supreme Court against holding early elections and voting for nominated members. Know the big things related to the matter.
1. The Supreme Court on Friday ruled that the mayor of the Municipal Corporation of Delhi (MCD) will be elected first and the nominated members will not have the right to vote in the corporation’s meetings. A bench headed by Chief Justice DY Chandrachud also directed the authority concerned to issue notice for the election of the mayor within 24 hours. The court also directed that the date for election of mayor, deputy mayor and other members will be fixed in the notice.
2. The top court said that it should be noted that the election of the mayor will be done in the first meeting of the MCD and after being elected, he will preside over the election of the deputy mayor. The Supreme Court also noted that a provision in the Municipal Corporation of Delhi Act indicates that the nominated persons shall not have the right to vote in the meetings of the corporation. The court also expressed its inability to accept the arguments of the MCD and the Lieutenant Governor of Delhi on certain issues.
3. The court was hearing a petition filed by Aam Aadmi Party leader Shelly Oberoi, challenging the Delhi Lieutenant Governor’s decision to allow nominated members to vote in the election of mayor and deputy mayor in the MCD. The petitioner had demanded early elections for the MCD mayor, deputy mayor and members of the standing committee.
4. Delhi Chief Minister Arvind Kejriwal termed the Supreme Court’s order on the mayoral election as a victory for democracy. At the same time, he alleged that the order of the court proves that both the Lieutenant Governor and the Bharatiya Janata Party were passing illegal and unconstitutional orders.

6. MCD sources told PTI on Friday that a letter proposing a new date for convening the Municipal House to hold the election of the Mayor of Delhi is expected to be sent to the Lieutenant Governor by Saturday evening. This proposal will be stamped by LG and notification will be issued.
7. On the order of the court, AAP said that this is its victory and people’s faith in the Supreme Court has increased. You said that this is his constitutional victory. The Supreme Court’s decision proved that LG is a liar and a dishonest man, he should resign. AAP leader Durgesh Pathak said that we are grateful to the Supreme Court. Court’s decision on Delhi Mayor election is a slap on the face of BJP.
8. Delhi’s Deputy CM Manish Sisodia said that it is clear from the Supreme Court’s order that LG Sahab constantly violates the Constitution and the orders of the Supreme Court, stopping the work of the people of Delhi and creating problems for the people. The LG who does not believe in the constitution should immediately resign from his post.
9. On the other hand, Delhi BJP welcomed the court’s order and said that it always wanted that the mayor’s election should be held as soon as possible. Delhi BJP leader Harish Khurana said that we welcome the decision of the Supreme Court. We always wanted the elections to be held at the earliest. It was the Aam Aadmi Party that did not allow elections to be held in the last three meetings of the MCD House.
10. 250 elected corporators, 10 MPs (seven Lok Sabha and three Rajya Sabha) and 14 MLAs from Delhi will vote in the mayoral election. Delhi Assembly Speaker has nominated 13 MLAs from AAP and one from BJP. The total votes for the mayoral election are 274. AAP has the votes of 134 corporators, 3 MPs and 13 MLAs. While BJP has 105 corporators, 7 MPs and one MLA vote. The Congress has nine councilors while two are independent. In the MCD elections held in December last year, AAP had won 134 wards and BJP 104. Later the councilors of Mundka joined the BJP.
